These Terms and Conditions (“Terms”) govern your access to and use of the website magicinmymarks.co.za (the “Website”) and any purchase you make through it. The Website is owned and operated by Jacqueline Dean, trading as Magic in my Marks (“we”, “us”, “our”), a sole proprietor based in Cape Town, South Africa. By accessing the Website or placing an order, you (“you”, “the customer”) agree to be bound by these Terms. Please read them carefully. If you do not agree, please do not use the Website or place an order.

1. Information about us

In accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002 (the “ECT Act”), we provide the following information:

•    Full name: Jacqueline Dean, trading as Magic in my Marks.

•    Legal status: Sole proprietor.

•    Main business: Sale of the book Magic in my Marks and related items, including pre-orders for collection at launch events or for delivery.

•    Email: magicinmymarks@gmail.com.

•    Payment processing: Payments are facilitated by PayFast, a registered South African payment gateway.

2. Products and pre-orders

The principal product currently offered is the book Magic in my Marks (the “Book”), offered on a pre-sale (pre-order) basis ahead of its launch.

By placing a pre-order you reserve a copy of the Book. Estimated availability and collection details are communicated at checkout and by email. The current launch and collection events are scheduled for Cape Town (Kelvin Grove) on 3 September 2026 and Johannesburg (Chartwell) on 5 September 2026. Dates and venues may change, and we will notify you of any material change.

Product descriptions and images are provided in good faith and as accurately as possible. Minor variations in colour or finish may occur.

3. Prices and payment

All prices are displayed in South African Rand (ZAR) and include VAT where applicable. The price of the Book is R250.00 per copy unless otherwise stated. Delivery charges, where applicable, are shown separately at checkout before you confirm your order.

Payment is processed securely through PayFast. We do not store your full card details.

Your order constitutes an offer to purchase. A contract of sale comes into effect once we accept your order and confirm it by email. We reserve the right to decline or cancel an order (for example, where stock is unavailable or payment is not authorised), in which case any amount already paid will be refunded in full.

4. Delivery and collection

Collection. Pre-ordered Books may be collected at the launch event you select, at the venue, date and time communicated to you. Your order confirmation and proof of identity may be required at collection.

Delivery. Where you select delivery, Books are sent by post or courier to the address you provide. Delivery timeframes are estimates only. In line with section 46 of the ECT Act, we will execute your order within 30 days of receipt of the order unless otherwise agreed; for pre-orders, dispatch or collection takes place from the stated launch date. Risk in the goods passes to you on collection or delivery.

It is your responsibility to provide a complete and accurate delivery address. We are not liable for delays or non-delivery caused by incorrect address details. Delivery charges are non-refundable except where the return arises from our error or a defective product.

5. Cancellations, returns and refunds

Your rights to cancel an order, return a product and obtain a refund are set out in full in our Refund and Cancellation Policy, which forms part of these Terms. In summary, you have a 7-day cooling-off right under the ECT Act, statutory protection for defective or incorrect goods under the Consumer Protection Act, and a full refund if we cancel a launch event at which you were due to collect.

6. Your consumer rights

Nothing in these Terms limits or excludes your rights under the Consumer Protection Act 68 of 2008 (the “CPA”) or the ECT Act. Where any provision of these Terms conflicts with those Acts, the Acts prevail to the extent of the conflict.

7. Intellectual property

All content of the Book and the Website, including text, illustrations, design, logos and images, is owned by or licensed to Jacqueline Dean trading as Magic in my Marks and is protected by copyright and other intellectual property laws. You may not reproduce, distribute or create derivative works from this content without our prior written consent. Purchase of the Book grants you a personal, non-transferable right to read and enjoy it, and does not transfer any intellectual property rights.

8. Privacy

We process your personal information in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA). By placing an order you consent to such processing for the purpose of fulfilling your order and communicating with you about it.

9. Limitation of liability

The Website is provided on an “as is” basis. While we take reasonable care to keep it accurate and available, we do not warrant that it will be uninterrupted or error-free.

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from your use of the Website or any product purchased. Our total liability for any claim is limited to the amount you paid for the relevant order. Nothing in these Terms excludes any liability that cannot lawfully be excluded, including liability under the CPA for defective goods.

10. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa, and any dispute is subject to the jurisdiction of the South African courts. Where the CPA applies, you may also refer a dispute to the National Consumer Commission or the relevant ombud.

11. Changes to these Terms

We may update these Terms from time to time. The version published on the Website at the time you place an order applies to that order. Please review the Terms before each purchase.
