This Privacy Policy explains how Jacqueline Dean, trading as Magic in my Marks ("we", "us", "our"), collects, uses, shares and protects your personal information when you visit or make a purchase through magicinmymarks.co.za (the "Website"). We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA"). This Policy forms part of our Terms and Conditions.
1. Who we are (Responsible Party and Information Officer)
For the purposes of POPIA, the Responsible Party is Jacqueline Dean, trading as Magic in my Marks, a sole proprietor based in Cape Town, South Africa. Our Information Officer is Jacqueline Dean, who can be contacted at magicinmymarks@gmail.com for any question about this Policy or your personal information.
2. The personal information we collect
Depending on how you use the Website, we may collect and process:
- Identity and contact details: your name, email address, telephone number, billing address and delivery address.
- Order information: the items you pre-order or buy, your order history, and the launch event or delivery option you select.
- Payment information: your payment is processed securely by PayFast. We do not receive or store your full card details; we receive confirmation of payment and limited transaction details.
- Communications: the content of messages you send us, for example by email or through our contact form.
- Technical and usage information: your IP address, device and browser type, and how you use the Website, collected through cookies and similar technologies (see section 8).
3. How we collect your information
We collect personal information directly from you when you place an order, contact us or RSVP to a launch event; automatically through cookies when you use the Website; and from our service providers, such as Shopify (which hosts the Website) and PayFast (which processes payments).
4. Why we process your information and our lawful basis
We process your personal information to process and fulfil your pre-order or order, including arranging collection at a launch event or delivery to you; to communicate with you about your order, a launch event or a query; to process refunds and handle returns in line with our Refund and Cancellation Policy; to comply with our legal and tax obligations; and, where you have consented, to send you marketing about the book and related news. You may withdraw marketing consent at any time using the unsubscribe link in any marketing email. We rely on the lawful bases permitted by POPIA, including your consent, the performance of our contract with you, compliance with the law, and our legitimate interests in running and protecting our business.
5. Who we share your information with (Operators and third parties)
We share personal information only as necessary, with:
- Shopify, which hosts and operates the Website on our behalf;
- PayFast, our South African payment gateway, which processes your payment;
- our delivery and courier partners, to deliver Books you have asked us to send to you;
- email and communication providers we use to contact you; and
- authorities or professional advisors, where we are required to do so by law or to protect our rights.
We do not sell your personal information.
6. Cross-border transfers
Some of our service providers, including Shopify, may store or process your personal information on servers outside South Africa. Where this happens, we take reasonable steps to ensure that your information enjoys a comparable level of protection, as required by section 72 of POPIA.
7. How long we keep your information and how we protect it
We keep your personal information only for as long as necessary to fulfil the purposes described above, including to meet legal, accounting and tax requirements. We take reasonable technical and organisational measures to protect your personal information against loss, unauthorised access and misuse, as required by section 19 of POPIA. No method of transmission over the internet is completely secure, and we cannot guarantee absolute security.
8. Cookies
The Website uses cookies and similar technologies to make the site work, remember your cart, and understand how the site is used. You can control or delete cookies through your browser settings. Disabling some cookies may affect how the Website functions.
9. Your rights under POPIA
Subject to the conditions in POPIA, you have the right to ask what personal information we hold about you and request access to it; to ask us to correct or delete personal information that is inaccurate, irrelevant, excessive, out of date or unlawfully obtained; to object, on reasonable grounds, to the processing of your personal information; to withdraw any consent you have given, without affecting processing that has already taken place; and to lodge a complaint with the Information Regulator. 11. Children
The Website and our products are intended for purchase by adults. We do not knowingly collect personal information from children under 18 without the consent of a parent or guardian. If you believe a child has provided us with their information, please contact us so that we can delete it.
12. Changes to this Policy
We may update this Privacy Policy from time to time. The current version will always be available on the Website, and we will update the "last updated" date above when we make changes.
