PAIA and POPIA Manual
Prepared in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA), read with the Protection of Personal Information Act 4 of 2013 (POPIA). Last updated: 24 June 2026.
1. Introduction
This manual is published by Jacqueline Dean, trading as Magic in my Marks ("the private body"), in terms of section 51 of PAIA. It explains how a person may request access to records held by Magic in my Marks, and sets out the personal information we process in terms of POPIA. Magic in my Marks is a sole proprietorship based in Cape Town, South Africa, whose main business is the sale of the book Magic in my Marks and related items.

3. The Guide on how to use PAIA

4. Records available in terms of other legislation
Certain records may be accessible in terms of other laws, such as the Consumer Protection Act 68 of 2008, the Income Tax Act 58 of 1962, the Value-Added Tax Act 89 of 1991 (where applicable) and the Basic Conditions of Employment Act 75 of 1997 (where applicable). Access to those records is governed by the relevant Act.
5. Categories of records held by Magic in my Marks
We may hold the following categories of records. Listing a category does not mean access will automatically be granted; each request is considered under PAIA.
- Customer records: names, contact details, delivery addresses, orders and correspondence.
- Financial records: sales, invoices, payment confirmations (processed by PayFast) and tax records.
- Supplier and service provider records: agreements and correspondence with printers, couriers, Shopify and PayFast.
- Marketing records: mailing list and consent records.
- Business records: the book's content and artwork, and general administrative records.
6. Records available without a formal request
Our Terms and Conditions, Privacy Policy, Refund and Cancellation Policy and Shipping Policy are freely available on our website and do not require a PAIA request.
7. How to request access to a record
A requester must complete the prescribed Form 02 (Request for Access to Record of Private Body) and submit it to the Information Officer at magicinmymarks@gmail.com. The request must provide enough detail to identify the record and the requester; identify the right the requester seeks to exercise and explain why the record is required for that right; state how the requester wishes to be informed of the decision; and be accompanied by the prescribed fees, where applicable.
8. Fees
Two types of fee may apply under PAIA: a request fee and an access fee. The Information Officer will notify you of any fee payable before processing the request. Fees are charged in line with the regulations made under PAIA, as amended from time to time. A requester may be required to pay a deposit where the search and preparation is likely to take significant time.
9. Grounds for refusing access
A request may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA, including the mandatory protection of the privacy of a third party who is a natural person (section 63), the commercial information of a third party (section 64), and other grounds provided in the Act.
10. Remedies
If a request is refused, a requester may lodge a complaint with the Information Regulator, or apply to a competent court, in terms of PAIA. There is no internal appeal within a private body.
11. Personal information processed (POPIA)
In terms of POPIA, we process personal information as set out in our Privacy Policy. In summary:
- Categories of data subjects: customers, website visitors, subscribers, suppliers and service providers.
- Categories of personal information: names, contact details, delivery and billing addresses, order and transaction details, marketing preferences, and website usage data.
- Purpose of processing: to fulfil orders and pre-orders, communicate with customers, process payments and refunds, comply with the law, and (with consent) send marketing.
- Recipients: Shopify, PayFast, courier and delivery partners, and email service providers, as described in our Privacy Policy.
- Cross-border transfers: some information may be processed outside South Africa by our service providers, subject to the safeguards in section 72 of POPIA.
- Security: we apply reasonable technical and organisational measures as required by section 19 of POPIA.
Data subjects may exercise their POPIA rights, including access, correction and objection, by contacting the Information Officer at magicinmymarks@gmail.com, and may complain to the Information Regulator using the details in section 3.
